Terms of Service

Last updated: March 2025. This is a general agreement for consumers and integrators (e.g. Google sign-in). MLS® Virtual Office Website rules are addressed separately — see links in §12 below.

1. Agreement

These Terms of Service (“Terms”) govern access to and use of the websites, tools, and online experiences described in §2 (collectively, the “Services”). By visiting or using any of the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

2. Who we are & what this covers

The Services are operated in connection with real estate brokerage activities carried on by Bryon Bertrim, REALTOR® (the “Operator”), including under the trade style Bryon Bertrim Real Estate and related branding. The Operator is a member of the Ottawa Real Estate Board (OREB) and participates in the Canadian real estate ecosystem under applicable board and CREA rules.

Nature of mystreetvalue.ca: The site hosts MyStreetValue™ / StreetValue™ — home-equity and automated-valuation-style experiences focused on Canadian markets (including the Ottawa area). Outputs are informational ranges and confidence indicators derived from models and third-party data; they are not appraisals, inspections, or professional valuations unless expressly stated otherwise in writing by a qualified professional.

These Terms apply to the Operator’s related online properties and brands, including without limitation:

mystreetvalue.ca — primary MyStreetValue™ / StreetValue™ experience described above;
mystreetvalue.com — companion domain used for the same or related real estate tools, landing pages, redirects, or marketing (availability of specific pages may change over time);
HomeSearchCanada (including HomeSearchCanada.ca and related domains or subdomains) — property search, listing discovery, and related real estate browsing tools operated in connection with the Operator;
MyProslist.com — contractor / professional referral, directory, or post-closing support experiences operated in connection with the Operator (including successor or related product names).

Additional sites, landing pages, or subdomains the Operator controls and labels as part of the same program are also covered. If you access MLS® sold data or comparable sales through our tools, §12 applies in addition to these Terms.

3. Eligibility & accounts

You must be able to form a binding contract where you live. Where we offer registration, OTP, or portal access, you agree to provide accurate information and keep credentials secure. You are responsible for activity under your account.

4. Acceptable use

You will not:

break any law or infringe others’ rights;
scrape, mine, bulk-download, or reverse engineer the Services except as allowed by law or written permission;
probe, disrupt, or overload our systems;
misrepresent affiliation with the Operator, OREB, CREA, MLS®, or PropTx; or use the Services to send spam or malware.

MLS® data accessed under licence may be subject to stricter rules — see §12.

5. Third-party services

The Services may embed or call third parties (for example, maps, analytics, messaging, hosting, identity, or payment providers). Their terms and privacy policies apply to their own processing. A non-exhaustive example: address and map features may rely on Google services subject to Google’s terms.

6. Intellectual property

StreetValue™, MyStreetValue™, branding, UI, text, graphics, software, and models are owned by the Operator or its licensors. MLS® and related marks are owned by CREA and used under licence where displayed. You receive a limited, revocable licence to use the Services for personal, non-commercial browsing unless we agree otherwise in writing.

7. Disclaimers

THE SERVICES AND ANY OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES (EXPRESS, IMPLIED, OR STATUTORY), INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUTPUTS WILL BE ACCURATE, COMPLETE, OR CURRENT. REAL ESTATE DECISIONS SHOULD BE CONFIRMED WITH QUALIFIED PROFESSIONALS.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES — EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICES IN ANY TWELVE-MONTH PERIOD IS LIMITED TO THE GREATER OF (A) CAD $100 OR (B) AMOUNTS YOU PAID US FOR THE SERVICES GIVING RISE TO THE CLAIM (IF ANY). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, THESE LIMITS APPLY TO THE FULLEST EXTENT ALLOWED.

9. Indemnity

You will defend and indemnify the Operator and its affiliates, suppliers, and personnel against third-party claims, damages, and costs (including reasonable legal fees) arising from your misuse of the Services or breach of these Terms, except to the extent caused by our gross negligence or wilful misconduct.

10. Suspension & termination

We may suspend or terminate access to protect users, comply with law, or enforce these Terms. You may stop using the Services at any time. Provisions that by nature should survive (disclaimers, limits, indemnity, governing law) survive termination.

11. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Courts in Ottawa, Ontario, have exclusive subject-matter jurisdiction, except where consumer protection law requires otherwise.

12. MLS® / VOW supplemental terms

Access to certain MLS® sold prices, comparable sales, or VOW-gated content requires acceptance of additional licence terms, including:

If there is a conflict between these general Terms and the MLS® / VOW documents for MLS® data, the MLS® / VOW documents control for that data.

13. Changes

We may update these Terms by posting a revised version and updating the “Last updated” date. Material changes may also be announced through the Services. Continued use after changes means you accept the revised Terms.
